1. Eligibility

The Loyalty Programs is open only to legal residents of the United States (including the District of Columbia), who are at least eighteen (18) years of age or who has reached the age of majority in his or her state of residence at the time of entry (the “Entrants”). Employees, officers and representatives of the Sponsor, and their respective affiliated companies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee (collectively, the “Promotion Entities”), are not eligible to participate. Subject to all federal, state, municipal, provincial, territorial, and local laws and regulations. Void in Puerto Rico.

2. To Participate

To participate in our giveaways or any other member programs or to claim our rewards, you must create your individual account. Entrants may enter for a chance to win a prize anytime from the announced start date but no later than the official end date of 11:59 PM, Eastern Time (the “Promotion Period”). All information provided by entrant must be complete, true and correct. Promotion submissions must be received by the end date of the promotion/giveaway in order to be eligible; entries received after that date will be deemed ineligible to win. All submitted entries become the property of the Sponsor and will not be acknowledged or returned; the Sponsor is not responsible for lost, late, inaccurate, incomplete, or misdirected entries. Entry is limited to one per person and per email address. Online entries will be deemed submitted by the authorized account holder of the e-mail address submitted at time of entry. By entering, you agree to be bound by the Official Rules (the “Rules”).

To be eligible to win, you’ll need to:

i. Create an account or Login to your existing account.
ii. Go to the Promotion’s page and click on the appropriate button to register your participation and to be entered to win.

The Sponsor’s computer database is the official time-keeping device for the Promotion. Eligible Entrants can enter the promotions through the Sponsor’s Promotion page and follow the links and instructions for entry. After you have fully completed the entry form and submitted the required information, you will automatically receive one (1) entry into the Promotion.

Multiple participants are not permitted to share the same email address. Any attempt by a participant to submit more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant’s entries and that participant may be disqualified. In addition, participant’s membership may be suspended or revoked by at Sponsor’s discretion without notice. Use of any automated, robotic, or third party system to participate is prohibited, and will result in disqualification.

3. Conditions of Participation

Our promotions will be offered to our members in accordance with selection criteria we will publish on our Website in conjunction with each promotional event. In the event that the selection criteria for a particular promotion is dependent on correctly answering a trivia question or any other skill contest, then we will publish the rules and guidelines for the trivia question or skill contest during the Promotion Period when the promotion is being held. Registered members must have a valid e-mail address and it is each member’s responsibility to update the Sponsor of any change of email address. Each promotion will be granted to a particular member “as is” with no warranty or guarantee, either express or implied outside of manufacturer’s limited warranty, if applicable. No transfer or assignment of a prize is permitted. Sponsor reserves the right to substitute a promotion for one of equal or greater value in the event the advertised prize is unavailable. Entrants agree to be bound by the terms of these Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining. Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Loyalty Programs or in the announcement of the prize.

4. General Conditions

If for any reason the operation or administration of the Promotion is impaired or incapable of running as planned for any reason, including but not limited to (a) infection by computer virus, bugs, (b) tampering, unauthorized intervention, (c) fraud, (d) technical failures, or (e) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion in whole or in part, at any time, without notice and award the Grand Prize using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Promotion or Sponsor’s Website; or (b) acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be granted to the authorized account holder of the email address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

5. Release and Limitations of Liability

By participating in the Promotion, Entrants agree to release and hold harmless the Sponsor, the Promotion Entities, their respective parents, employees, officers, directors, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Promotion; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Promotion or receipt of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Promotion or downloading any materials in this Promotion. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

6. Drawing and Notification

The potential winner(s) will be selected in a random drawing from among all eligible entries received by the Sponsor whose decisions are final and binding. The drawing will be conducted on or about seven (7) days from the last date of entry. Odds of winning will depend on the total number of eligible entries received throughout the Promotion Period. Winner(s) will be contacted by email and must reply to accept or reject prize within seven (7) business days of first notification sent by Sponsor. Potential winners must acknowledge their selection as and confirm their acceptance to being selected as a prize winner within seven (7) days of being notified. If winner does not respond within the designated period, Sponsor reserves the right to conduct a new drawing and select a replacement winner.

7. Prize Awards

Prizes will be awarded within fourteen (14) days after winner verification. No substitution, assignment or transfer of the prize is permitted, except by Sponsor, who reserves the right to substitute the prize or prize component with another of comparable or greater value for any reason. All federal, state, local taxes and any other fees associated with the prizes or promotions shall be the sole responsibility of each winner. Potential winners may be required to sign and return a sworn Affidavit of Eligibility, and Liability and Publicity Release. If confirmation from the selected winner is not received, or if required documentation is not returned within ten (10) business days of notification, or if notification is returned as undeliverable, any prize will be forfeited and an alternate winner will be selected by random drawing. Prize winners will be identified on our website or other public releases by their first name and last initial. Expenses not specified will be the member’s responsibility. Participants of any our promotions are only eligible to win once every 30 days. Additionally, winners are restricted to one prize per Promotion per household every 30 days.

The Affidavit sent to a potential US winner will require that the winner provide their Social Security Number to the Sponsor, which will be used solely for tax reporting purposes for any prize whose Approximate Retail Value (“ARV”) is greater than $600.00 USD. Winner(s) should note that the value of the accepted prize is taxable as income and an IRS Form 1099 will be filed in the name of the winner(s) for the value of the prize (applicable to US winners only). Restrictions, conditions and limitations may apply. The ARV of the prize will be announced at the time of the prize selection.

8. General Rules & Limitations

Acceptance of any prize or promotion shall constitute permission to perpetually use each member’s name, prize or promotion received, hometown, likeness, statements, and biographical information worldwide for print publication, online posting, and any other promotional purposes without further compensation, except where prohibited by law. By participating in the Loyalty Programs, you agree to release Sponsor and its officers, directors, employees, agents, successors, and assigns from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, or misuse of any prize or promotion.

Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Loyalty Programs, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Loyalty Programs, the processing of entries, the announcement of the prizes, in any promotion-related materials, or that may limit prize fulfillment or a participant’s ability to enter the Promotion. Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these Rules. As permitted by law and in accordance with the Sponsor’s Privacy Policy, Sponsor may use information provided by members to send announcements about the Sponsor’s or its partners’ products and services, via electronic and ordinary mail.

9. Other Discounts and Promotions

From time to time, businesses advertising on our Website may offer discounts and promotions. You agree that it is the sole responsibility of such businesses to honor the discount or promotion that they advertise on our Website. All expiration dates for such discounts or promotions are set at the sole and absolute discretion of the business offering the discount or promotion. We have no input or control over the establishment of any expiration dates for such businesses, nor do we have any obligation to supervise such businesses to ensure that they comply with all applicable laws and regulations. Each business is responsible for its own compliance with the applicable laws and regulations.

10. Privacy Policy

The Sponsor’s information collection practice is described in the Privacy Policy, the link to which is posted at the bottom of the Website’s home page as well as other pages within the Website. If you would like your name removed from Sponsor’s mailing list or to deregister as a member of Caribbean BlueBook, please email us at rewards@caribbeanbluebook.com and your name will be removed within sixty (60) days of the request. Please review the Website’s Privacy Policy before submitting personal information.

11. Disclaimer

Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry submissions, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason any electronic aspect of the Loyalty Programs is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Loyalty Programs or promotional event, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Loyalty Programs and/or event. Sponsor reserves the right to disqualify any individual who tampers with the entry process. Sponsor may prohibit any member from participating if it determines that said member is attempting to undermine the legitimate operation of the Loyalty Programs by cheating, hacking, deception or other unfair playing practices or intending to abuse, threaten or harass other members. Caution: Any attempt by a participant to deliberately damage the Website or undermine the legitimate operation of the Website is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the law. SPONSOR EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, REPRESENTATIONS, OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, REGARDING THIS PROMOTION OR THE MERCHANTABILITY, QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY REWARDS OR PROMOTIONS, OR COMPONENT OF A REWARD OR PROMOTION.

12. Disputes

Except where prohibited by law, by participating in our Loyalty Programs you agree that: (i) all issues and questions concerning the interpretation, validity, and enforceability of these Rules or the rights and obligations of participants and Sponsor and its agents and aspects related thereto shall be governed by and construed exclusively in accordance with the laws of the State of New York, without regard to its rules on conflicts of law; (ii) any action at law or in equity arising out of or relating to these Loyalty Programs, or the awarding of the prizes, shall be filed only in the state or federal courts located in the State of New York, and entrants hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action; (iii) any and all disputes, claims, and causes of action arising out of or connected with these Loyalty Programs shall be resolved individually, without resort to any form of class action; (iv) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Loyalty Programs but in no event attorneys’ fees; (v) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”); and (vi) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. All claims you bring against Sponsor or the Website must be resolved in accordance with this Section. All claims filed or brought against us contrary to this provision shall be considered improperly filed. Should you file a claim contrary to this Section, you agree that Sponsor may recover attorneys’ fees and costs for the improperly filed claim, provided that Sponsor has notified you in writing of the issue and you have failed to properly withdraw the claim.

Rewards and promotional items are non-transferable. All federal, state, provincial and local laws and regulations apply; void where prohibited.
